Terms of Service

Welcome to Beyond Borders (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of our website, https://trybeyondborders.com (the “Site”), and our recruiting and placement services (collectively, the “Services”).

By using our Site or Services, you agree to these Terms. If you do not agree, please do not use our Site or Services.

1. Overview

Beyond Borders connects businesses (“Clients”) with qualified remote professionals (“Candidates”) from around the world. We act as a headhunter agency and are not the employer of record for any Candidate unless otherwise agreed in writing.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use our Services.

3. Use of Services

You agree to use our Site and Services solely for lawful business purposes. You may not:

  • Violate any laws or regulations;
  • Upload or transmit malicious code;
  • Share or misuse confidential candidate information;
  • Resell or replicate our services without consent.

We may suspend or terminate access for violations of these Terms.

4. Fees and Payments

To initiate a candidate search, Clients pay a $500 deposit through our secure payment processor (Stripe).

Refundable Deposit (If No Hire):

  • The $500 deposit is fully refundable only if no hire is made through Beyond Borders.

Placement Fee (Upon Hire):

  • If a hire is made, the Client authorizes Beyond Borders to automatically charge 30% of the Candidate’s first-year salary to the same payment method used for the deposit.
  • The placement fee is charged when the candidate accepts a job offer or contract, whichever occurs first.

Non-Refundable After Placement:

  • Once a successful placement or replacement has been made, both the $500 deposit and the 30% placement fee are non-refundable.

By providing your payment information, you authorize these transactions under these conditions.

5. 6-Month Replacement Guarantee

If the placed candidate leaves or does not work out within six (6) months of the start date, Beyond Borders will conduct one replacement search at no additional cost.

  • The replacement guarantee applies only once per initial hire.
  • If a replacement candidate is successfully placed, the guarantee is considered fulfilled.
  • After a successful first placement or replacement, no refunds will be issued for either the $500 deposit or the 30% placement fee.

6. Refund Policy

If no hire is made, your $500 deposit will be refunded in full to your original payment method.
Once a successful placement or replacement has been completed, all payments (including the $500 deposit and 30% placement fee) are final and non-refundable.

7. Confidentiality

Clients and Candidates agree to maintain the confidentiality of any non-public or sensitive information shared during the recruitment process.

8. Intellectual Property

All content on this Site—including text, images, graphics, and logos—is the property of Beyond Borders or its licensors. You may not reproduce or distribute any part of the Site without prior written consent.

9. Disclaimers

The Site and Services are provided “as is.” We make no warranties that:

  • Any candidate will meet your expectations or remain employed beyond the guarantee period;
  • The Site will be free of errors or interruptions;
  • Candidate information is verified or complete.

Hiring decisions and employment relationships are the Client’s sole responsibility.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Beyond Borders and its affiliates are not liable for indirect, incidental, or consequential damages arising from your use of our Services.
  • Our total liability is limited to the total amount you paid to Beyond Borders in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Beyond Borders harmless from any claim or loss arising from your use of our Services or violation of these Terms.

12. Privacy

Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

13. Governing Law

These Terms are governed by the laws of the State of [Insert State], U.S.A.
Any disputes shall be handled in the courts of [Insert City, State], unless otherwise required by law.
